These Terms of Service (“Terms”) are a legal agreement between you and AxialProgress, LLC (“AxialProgress,” “we,” “us,” or “our”), the company that operates the AxialProgress website at axialprogress.com and any related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Who can use AxialProgress
You may use the Service only if you are at least 18 years old and located in the United States. If you do not meet both of these requirements, please do not create an account.
You agree to provide accurate information when you create an account, keep that information up to date, and keep your password secure. You are responsible for activity under your account.
2. AxialProgress is independent and informal
AxialProgress is an independent product. We are not affiliated with, endorsed by, or sponsored by the American Registry of Radiologic Technologists (ARRT), any radiography program, any hospital, or any government body.
The Service is a personal study and competency-tracking tool. It is not an official program record, an exam preparation product, or a substitute for the records your educational program requires you to keep. Your program decides which trackers it accepts; we make no claim about whether AxialProgress will be accepted by any specific program.
3. Your data is yours, your patients’ data is theirs
AxialProgress is designed to track your training, not patient encounters. The Service has no fields for patient names, medical record numbers, dates of birth, addresses, or any other information that could identify a real patient.
You agree not to enter Protected Health Information (PHI), as defined under the Health Insurance Portability and Accountability Act (HIPAA), or any other identifying patient data into the Service. If you do, you are violating these Terms and we may remove the content and suspend or terminate your account.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems.
- Scrape, crawl, copy, or otherwise systematically extract data from the Service except as expressly permitted (such as the CSV export of your own data).
- Resell, sublicense, or redistribute the Service or any portion of it.
- Use the Service to harass, defame, impersonate, or harm any person.
- Interfere with or disrupt the Service or its security.
- Upload viruses, malware, or any code intended to damage or surveil systems or other users.
- Use automated means (bots, scrapers) to interact with the Service except where we explicitly support an API.
5. Pricing
The Service is currently free for individual student use. We may introduce paid features in the future. If we do, we will give you clear notice before any feature you currently use becomes paid, and your existing data will remain accessible to you.
6. Your content
You own the exam logs, notes, and other information you enter into the Service (“Your Content”). By using the Service, you grant us a limited, non-exclusive license to host, store, and display Your Content solely so we can operate the Service for you.
You can export Your Content as a CSV file at any time. You can also delete your account, which will permanently delete Your Content from our active systems within 30 days, subject to limited backup retention for security and disaster recovery.
7. Our intellectual property
The AxialProgress name, logo, branding, software, design, copy, and all other materials we provide are owned by AxialProgress, LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
8. Termination
You can stop using the Service and delete your account at any time from your account settings.
We can suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, you have entered PHI, your activity poses a security or legal risk, or for any other reason at our discretion. We will try to give reasonable notice when we can.
Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, intellectual property, and governing law) will survive.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet the requirements of any educational program or accrediting body. We do not provide medical, clinical, legal, or educational advice. You are responsible for verifying that your records meet your program’s requirements.
10. Limitation of liability
To the fullest extent permitted by law, AxialProgress, LLC, its officers, members, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our total cumulative liability to you for any claim arising out of or related to the Service or these Terms will not exceed one hundred U.S. dollars (US$100), or the amount you have paid us in the twelve months before the event giving rise to the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless AxialProgress, LLC and its officers, members, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service in violation of these Terms, (b) your entry of PHI or other prohibited content into the Service, or (c) your violation of any law or third-party right.
12. Changes to the Service
We are an active product and we will change, add, and remove features over time. We may modify or discontinue any part of the Service at any time. When we make material changes that affect you, we will try to give you reasonable notice through the Service or by email.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If the changes are material, we will give you notice (for example, by email or by a banner inside the Service) before they take effect. By continuing to use the Service after the changes take effect, you agree to the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.
Before filing any claim, you agree to first contact us at the address below and try to resolve the dispute informally for at least sixty (60) days.
